Is my son required to pay spousal maintenance?
My son got married and his wife left him four months into the marriage. He signed a document that she wrote up and it was notarized saying that he would pay her a certain amount per month. I’ve been told this is unenforceable. Is that true? She left him four months in to the marriage and he has paid her the money for the last 8 months. He just got out of the Army and has no job currently. They are not formally separated or divorced. Does he need to continue paying her?
Answer:
He should not have to pay her anything now that he is out of the Army. There is likely no spousal due either party.
Under AZ law, a short term marriage does not normally qualify for Spousal Maintenance.
