When you are dealing with a divorce case, you want to work with an attorney who makes you feel comfortable, understands your needs, and gets the results you want. Sometimes you choose an attorney and later realize that he or she isn’t exactly what you had hoped for. Your attorney might not return your calls, suggest compromises you are uncomfortable with, or simply be unable to really hear what you need. If you are working with an attorney that you are not happy with, it is your right to seek to change your representation.
If your case has already been filed with the court, you will need to get permission from the court to terminate your current attorney. If you let your current attorney know you would like to terminate his services, he can then ask the court for permission to withdraw from the case. Changing representation is generally not a problem. In Family Law it is rare for a Court to deny your right to change your attorney. However if you do so just prior to a trial do not expect the Court to give you more time for your attorney to get ready for the trial
If you would like to change representation, follow these steps:
- Begin researching and meeting with new attorneys. Take the time to find someone you feel completely comfortable with and who totally understands your goals in the case.
- Your new attorney can notify your current attorney that you have decided to seek legal assistance elsewhere and that you would like him or her to withdraw from the case. The new attorney can handle this sometimes uncomfortable situation for you.
- Your new attorney can ask for a copy of your file. The documents in that file belong to you and you have paid for them, so it is important that the new attorney to be properly prepared to represent you.
- Get your bill from your existing attorney and pay it if you agree with it. If you have a dispute with the amount, you can try to work it out or you can contact the Arizona State Bar for information on fee disputes.
