How Child Support Is Handled in Arizona
Child support in Arizona is determined using a formula adopted by the Arizona Supreme Court. The calculation starts with the monthly gross income of each parent. From that total, the court establishes a basic support amount. Then, additional factors are considered — including medical insurance for the child, child care costs, educational expenses, the child’s age, and support for any other children.
Once the amount is determined, child support is typically paid via wage assignment. The employer withholds the specified amount from wages and forwards it to the Support Payment Clearinghouse. If the employer fails to withhold, the paying parent is still legally responsible for making timely payments. Payments made directly to the custodial parent without going through the Clearinghouse may be considered a gift, unless there is a written agreement stating otherwise.
Modifying or Stopping Child Support
If you need to request a change to your child support order — for instance, if your financial circumstances have changed — a lawyer can help you navigate the process successfully. To seek a modification, you’ll need to file a formal request with the court, along with documentation of your financial status.
If a child reaches the age of majority or other conditions change, you must file for a reduction or termination of support. It does not happen automatically. Taking the proper legal steps ensures your obligations remain fair and appropriate.
Back Support, Grandparents’ Rights, and Special Circumstances
If a non-custodial parent has failed to meet their support obligations, the court may order retroactive child support — commonly up to three years prior. The court may also award reimbursement for unreimbursed birthing expenses when warranted.
Grandparents may also have visitation rights under certain circumstances. If one parent is deceased, missing, or unfit, grandparents can petition the court for visitation, which courts may grant based on the best interest of the child.
In cases involving drug or alcohol abuse, neglect, or other significant risks, the court has options to protect the child. These may include supervised visitation, psychological evaluations, or other protective measures.
